Nottingham Hill Association is a homeowner community with a private beach on Lake George in beautiful Hague, NY. The Association is made up of several families in the area that own rights to the beach and is governed by an elected board of directors. All rules and regulations are voted on by all members with a majority wins process.


Beach Rules

ARTICLE X – The Beach and Dock Area Regulations

 

Rule 1. Prohibited Behavior by Short-Term Renters. (May 2023)

Notwithstanding any other provisions in these Bylaws or any other rules and regulations of the Association, the following specific provisions (the "Short-Term Renter Provisions") shall apply exclusively to Short-Term Renters, defined as those persons who lease or otherwise occupy a property in the jurisdiction of the Association for a period of less than thirty (30) consecutive days:

(a)    Short-Term Renters shall not:

                                                              i.      Consume alcoholic beverages;

                                                             ii.      Use, possess, sell, or distribute any illegal drugs or controlled substances, as defined by state and federal laws;

                                                           iii.      Possess glass bottles, drinking vessels, or other glass beverage containers;

                                                           iv.      Use speakers or noise makers, however, personal headphones are acceptable;

                                                             v.      Sports of any kind (including racquet sports, ball sports, and cornhole);

                                                           vi.      Use the dock;

                                                         vii.      Use of shed

                                                       viii.      Pets of any kind at the beach area.  

 

 

 

 

 

 

                                                           ix.      Bring more than the maximum number of individuals from a rented lot, including the renter(s) to the beach area. The maximum number of individuals from a rented lot, including the renter(s) is calculated by the following formula: (Number of Bedrooms in the Rented Lot x 2) +

Rule 2.              Prohibited Behavior by All Individuals.

Notwithstanding any other provisions in these By-laws or any other rules and regulations of the Association, all individuals, including Short-Term Renters, shall not:

a.      Use of open flames of any kind (including bonfires, campfires, and fire pits) or grilling;

b.      Use Tobacco, Marijuana, or Vaping Technology;

c.       Possess glass bottles, drinking vessels, or other beverage containers;

d.      Have “Loud Parties” as defined in the By-laws;

e.      Use of fireworks, firecrackers, or other incendiary devices;

f.        Launch a powered watercraft at the beach area;

g.      Drive a trailer beyond the gravel road surface;

h.      If permitted to bring pets, bring pets to the beach area during the high season, defined as the Saturday immediately preceding Memorial Day through Labor Day each calendar year, between the hours of 8:00 AM (Eastern Standard Time) and 7:00 PM (Eastern Standard Time); (September 2023)

i.        If permitted to bring pets, leave pets unattended and fail to clean up after their pets and remove all waste from the beach area; or

j.        Use, traverse, or otherwise trespass on adjoining beaches, docks, or water platforms not within the beach area.

Rule 3.             Dock Regulations

a.      Docking privileges apply only to homeowners

b.      Dock spaces cannot be reserved unless you intend to put a boat in the water (May 2024)

c.       Dock Assignments will be made annually and assigned by seniority. Docking seniority cannot be passed through sale of the property but can be kept through property transfer within the Family (August 1983) Boats should not be placed in the water until dock spaces are officially assigned. The board will send an email in the first week of April to assign spots according to seniority and who has a boat (May 2024)

d.      Boats shall not exceed 20 ft in length including the mounted motor

e.      Mooring whips may be installed at the member's expense but do not signify a permanent spot. Spots are assigned each season and can be reassigned the following season.

 

Rule 4.              ASSOCIATION USE OF UNASSIGNED DOCK SPACES 

The dock has ten spaces, each 20’ in length.  In the event that all spaces are not being used for a season the unassigned dock spaces will be shared by all members throughout the season.  The members agreed that these spaces should be fairly and equally shared by all members on a courtesy basis.  The temporary mooring of smaller crafts, such as peddle boat, sailboat, rowboat, canoe, jet ski, etc. on the dock was agreed to.  A space can be used by a member on a weekly basis while the member is in Hague, and the craft removed from the dock when the member leaves.  It is anticipated that members will coordinate amongst themselves for fair and equal usage. 

 

Rule 5.             Canoe Rack

a.      The Canoe Rack privileges apply to homeowners

b.      Rack Assignments will be assigned annually at the start of each season in the May meeting.

 

Rule 6.              Guest Policy.

Guests are only permitted when accompanied by a Property Owner, or a Tenant, at all times. Again, Short-Term Renters may not bring their own Guests.

Rule 7.              Carry-In/Carry-Out Policy.

Notwithstanding any other provisions in these By-laws or any other rules and regulations of the Association, the following provisions (the "Carry-In/Carry-Out Provisions") shall apply:

a.      All individuals must:

                                                              i.      Remove all trash before leaving the beach area;

                                                             ii.      Return all Association and personal items to their storage locations before leaving the beach area, including watercraft, toys, and chairs;

b.      Short-Term Renter must:

                                                              i.      Remove all personal items before leaving the beach area. Renters are not permitted to store personal items or watercraft at the beach area for any period of time; and

                                                             ii.      Remove all their trash and garbage before leaving the beach area.

Rule 8.              Swimming Area.

Notwithstanding any other provisions in these By-laws or any other rules and regulations of the Association, the following provisions (the "Swimming Area Provisions") shall apply:

a.      Watercraft anchored anywhere near the swimming area are to be monitored in-person by the owner or responsible party at all times; and

b.      Watercraft owner or responsible party must maintain control of the craft, whether in use or while anchored, and will be held liable for any damage by the craft to Association or member property resulting from negligence, changing weather conditions, or Acts of God.

Rule 9.              Supervision of Children.

Children under 12 years of age must be accompanied by and supervised by a responsible person at least 18 years of age.

Rule 10.          Requests for Exceptions.

Requests for temporary exceptions to the Beach Area Rules and Regulations shall be governed by the following provisions:

a.      Form of Request. Any individual who believes that compliance with a specific rule or regulation would cause undue hardship may submit a written request for an exception to the Association's management. The request should detail the nature of the hardship, the specific rule or regulation in question, and the proposed alternative action.

b.      Review and Decision. The Association's Board of Directors, or a designated committee of delegates, will review the request in a timely manner and may, at its full discretion, grant an exception if it finds that the exception will not unduly impact the community, the intent of the rule or regulation will still be met, and granting the exception is in the best interests of the Association and its members. The decision will be communicated to the requester in writing and will include any conditions or limitations associated with the exception.

 

c.       Limited Scope and Duration. Any exception granted under this provision is limited to the specific instance identified in the request and does not constitute a general waiver or amendment of the rule or regulation. Unless otherwise specified in the decision, the exception will be valid for a period of one year from the date of the decision, after which the requester may submit a new request for consideration.
